The Council will have the power to enact, modify or repeal any rules and regulations necessary to establish minimum working standards in fast food restaurants. Decisions will be made on the basis of the favorable vote of at least six Board members. In the event of any discrepancies or conflicts between Council decisions and existing rules of other state agencies, the Council decision shall prevail.

As of January 2023, the Council can set a minimum wage for fast food workers of no more than $ 22 per hour. In 2024 and annually thereafter, the highest wage may increase by less than 3.5% or the rate of change in the U.S. CPI for urban wage earners and office workers.

The Council cannot create new paid vacation benefits or regulations related to predictable scheduling.

Progress to date: The bill was first tabled in January 2021 by Assemblyman Chris Holden and Governor Newsom signed it into law on September 5, 2022. DIR is currently awaiting the petition. which will allow the Fast Food Council to begin meeting and making changes on behalf of fast food workers.
