Name of the policy: AB 257: Fast Food Accountability and Standards Recovery Act or FAST Recovery Act

Overview: In September 2022, California Governor Gavin Newsom signed legislation to provide fast food workers with better wages and working conditions.

Food policy category: Food service

Program Goals: To support the health, safety and well-being of fast food workers.

How it works: The legislation applies to fast-food chains with 100 or more locations nationwide. Authorizes the creation of a Fast Food Council to set standards for fast food workers’ minimum wages, health and safety conditions, workplace safety, and protections against discrimination and harassment.

The California Department of Industrial Relations (DIR) must first receive a petition signed by 10,000 fast-food workers approving the creation of the council. Then, within 90 days of the petition being approved, council members will be appointed to hold their first meeting. They will continue to meet every six months until 2029.

The Fast Food Council will consist of ten members appointed by Governor Newsom, the Speaker of the Assembly and the Senate Rules Committee:

The Council shall have the authority to issue, amend or repeal all rules and regulations necessary to establish minimum fast food service standards. Decisions will be made based on a vote of at least six council members. If there are inconsistencies or conflicts between the decisions of the Council and the existing rules of other state agencies, the decision of the Council shall prevail.

Beginning in January 2023, the Council can set a minimum wage for fast food workers that will not exceed $22 an hour. In 2024 and each year thereafter, the maximum wage can increase by either 3.5 percent or the rate of change in the U.S. Consumer Price Index for city wage earners and employees, whichever is less.

The council may not create new paid time off compensation or predictability regulations.

Progress to date: The bill was first introduced by Assemblyman Chris Holden in January 2021 and signed into law by Governor Newsom on September 5, 2022. DIR is currently awaiting receipt of a petition to allow the Fast Food Council to begin meeting and making changes on behalf of workers with fast food.

Why it matters: The FAST Recovery Act was first enacted in response to reported safety violations affecting fast-food workers during the pandemic. Wage theft – when employers do not pay their employees the full amount they are entitled to – along with harassment and discrimination by customers and employers are common complaints from fast food workers. Passage of the bill will place responsibility on fast food corporations as a whole, rather than individual franchise owners, and workers will receive more of the respect and care they deserve. Governor Newsom says the new legislation “gives hard-working fast food workers a stronger voice and a seat at the table to set fair wages and critical health and safety standards across the industry.”

Similar Practices: New York’s Fair Workweek Act, introduced in June 2021, gives fast-food workers more rights regarding hours and schedules. New York State enacted a minimum wage for fast food workers, raising the minimum wage for fast food workers in New York City to $15 in 2018 (from $13.50 in 2017) and for those in the rest of New York State in 2021 (from $14.50 in 2020).

Assessment: Although the FAST Recovery Act received support from the governor, fast-food workers, unions and many other labor rights organizations, the restaurant industry strongly opposed it. There is concern that raising the minimum wage will lead to higher and less attractive prices for consumers and, in turn, lower profits for franchises. In addition, some are concerned that the legislation will lead to an increase in lawsuits against employers. On September 6, one day after the law was signed, a coalition of restaurants filed a referendum request to repeal the law. Referendum proponents must collect at least 623,212 signatures from registered voters by December 4, 2022 to be placed on the 2024 ballot.
